Application refers to Bite AI, the software program provided by the Company downloaded by You on any electronic device.

Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
Health Data means health and fitness information You choose to log in the Application or share with it from Apple Health, such as workouts, body weight, active energy, and nutrition.
Personal Data is any information that relates to an identified or identifiable individual.
Service refers to the Application and Website.
Service Provider means any natural or legal person who processes the data on behalf of the Company.
Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself.
Website refers to Bite AI, accessible from getbiteai.com
You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Collecting and Using Your Personal Data

Types of Data Collected

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

• Email address
• First name and last name
• Phone number
• Profile information, such as Your username, profile photo and bio
• Height, weight, age, sex, activity level and nutrition goals
• Health and nutrition data, including data You choose to share from Apple Health
• Food images, meal data and progress photos
• Posts, comments and group messages You create in the Service

Usage Data

Usage Data is collected automatically when using the Service. Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

Health and Fitness Data

With Your permission, the Application reads workouts, body weight and active energy from Apple Health (HealthKit) so that Your calorie and macro targets can reflect Your actual activity, and writes the nutrition data You log back to Apple Health. You control this access in the Apple Health app and in Your Device settings, and You may revoke it at any time without losing access to the rest of the Service.

Data We receive from Apple Health is never used for advertising or marketing purposes, and is never shared with, sold to, or disclosed to any third party for advertising or marketing purposes, or to data brokers. We use it solely to provide the health and fitness features You have asked for.

If You pair an Apple Watch, a summary of today's nutrition totals and goals syncs to the paired watch so You can view Your progress there.

Food Images and AI Analysis

When You photograph a meal, scan a barcode or label, or describe a food, the image and the accompanying text are sent to Our AI service providers, including OpenAI, which analyze them to estimate the food items and their nutritional values. These images and descriptions are processed to provide the Service, including returning the estimate to You and storing Your meal history in Your Account. AI-generated nutrition estimates are approximations and may be inaccurate.

Progress Photos

Progress photos You add are stored for Your own tracking and are visible only to You. They are not published to other users unless You choose to share them yourself.

Social Features

The Service includes social features. Your profile information, posts, comments, reactions and group messages are visible to other users of the Service, and information You publish in these areas may be seen, saved or re-shared by them. Please do not post anything You would not want other users to see.

You can report content and block other users from within the Application. We review reports and may remove content, or restrict, suspend or terminate an Account, where content or behavior violates Our Terms of Service.

Subscriptions and Purchases

Subscriptions are purchased and billed through Your Apple App Store account. We do not receive or store Your payment card details. Your subscription status is processed through Our subscription-management provider so that the Application knows which features to unlock for Your Account.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

To provide and maintain our Service, including to monitor the usage of our Service.
To manage Your Account and provide access to different functionalities of the Service.
To provide AI-powered nutrition analysis of your food images, food descriptions and meal data.
To calculate and adjust Your nutrition targets using Your profile, logged meals and, where You have granted permission, Your Apple Health workouts, weight and active energy.
To operate social features, including displaying Your profile, posts, comments and group messages to other users, and handling reports and blocks.
To manage Your subscription and confirm Your access to premium features.
To contact You regarding updates, security notifications, reminders You have enabled, or customer support.
To provide personalized recommendations based on your nutrition goals and habits.
To improve our Service through data analysis and user feedback.

Sharing Your Personal Data With Service Providers

We share Personal Data with Service Providers only as needed to operate the Service. These providers are permitted to process the data on Our behalf and for no other purpose. The categories of Service Providers We use are:

Cloud hosting and database (Supabase), which stores Your Account, meal history, images and social content.
Subscription management (Adapty), which records Your subscription status and entitlements.
Sign-in providers (Sign in with Apple, Google Sign-In), which authenticate You and provide the identifier and email associated with the account You sign in with.
AI nutrition analysis providers, including OpenAI, which process Your food images and descriptions to return nutrition estimates.
First-party analytics, which we operate to record app-interaction events and device identifiers so We can understand how the Service is used and where it fails.

We do not sell Your Personal Data. We may also disclose Personal Data if required to do so by law or in response to valid requests by public authorities.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. Your Account data, meal history, images and health data are retained while Your Account remains active, and are deleted when You delete Your Account. We will retain and use Your Personal Data to comply with our legal obligations, resolve disputes, and enforce our agreements.

Delete Your Personal Data

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You. You can delete Your Account directly in the Application, from Settings, which removes Your profile, meal history, images and health data from Our systems. You may also contact Us at team@hypedev.co to request access to, correct, or delete any personal information.

Deleting Your Account does not delete data stored in Apple Health on Your Device. You can remove nutrition data written by the Application from within the Apple Health app.

Security of Your Personal Data

The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. Data is transmitted over encrypted connections and access to Account data is restricted to the Account holder and to authorized personnel and Service Providers. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.

Children's Privacy

Our Service does not address anyone under the age of 13, and the Application asks for Your age and does not permit users under 13 to create an Account. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us and We will delete it.

Changes to this Privacy Policy

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date. You are advised to review this Privacy Policy periodically for any changes.
